These Terms of Use / End User License Agreement (“Terms”) govern your access to and use of Mixverse: Cocktail Recipes (“Mixverse,” “the app,” “we,” “us,” or “our”), including our mobile applications, subscriptions, creator tools, AI features, content, website, and related services.

By downloading, accessing, or using Mixverse, you agree to these Terms. If you do not agree to these Terms, do not use the app.

1. Eligibility and Legal Drinking Age

Mixverse is intended only for users who are of legal drinking age in their country or region.

By using Mixverse, you confirm that:

You are legally allowed to view cocktail and alcohol-related content in your country or region.

You meet the legal drinking age requirement where you live.

You will comply with all alcohol laws and regulations that apply to you.

You will use the app responsibly.

Mixverse is not intended for children.

If you are not of legal drinking age in your country or region, you must not use Mixverse.

2. What Mixverse Provides

Mixverse is a cocktail recipe and mixology app. Depending on your platform, account, subscription, location, and available features, Mixverse may allow you to:

We may modify, add, limit, suspend, or remove features at any time.

3. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, access, and use Mixverse for your personal or permitted creator/business use.

You may not:

Copy, modify, reverse engineer, decompile, or disassemble the app, except where allowed by law.

Sell, rent, lease, sublicense, distribute, or commercially exploit the app without permission.

Circumvent subscriptions, entitlements, access controls, or security systems.

Mixverse is licensed to you, not sold.

4. Accounts and Sign-In

Mixverse supports:

You are responsible for keeping access to your account secure through your sign-in provider.

If you use guest mode, some features may be limited. Guest data may not be recoverable if you delete the app, change devices, clear app data, or lose access to the local app installation.

Create accounts for fraudulent, abusive, or misleading purposes.

Mixverse may offer paid subscriptions and paid features, including Premium and Creator plans.

Subscription features may include, depending on the plan, platform, and availability:

Subscription details are shown in the app before purchase.

6. Auto-Renewable Subscriptions

Mixverse may offer auto-renewable subscriptions.

Before you purchase, the app or store purchase sheet will show relevant subscription information, such as:

Auto-renewable subscriptions renew automatically unless cancelled before the renewal date according to the rules of the store where you purchased the subscription.

You are responsible for reviewing the subscription terms shown at the time of purchase.

7. Billing and Payment

Payments are processed by Apple App Store or Google Play, depending on your device and platform.

We do not directly collect or store your full payment card details.

By purchasing a subscription or paid feature, you agree to the payment, billing, renewal, cancellation, refund, and tax rules of the app store where you made the purchase.

Your subscription may be managed through Apple App Store, Google Play, RevenueCat, or other purchase entitlement systems used to provide subscription access.

8. Free Trials and Promotional Offers

Mixverse may offer free trials, introductory offers, promotional pricing, or limited-time offers.

Trial availability, duration, price, and eligibility may vary by user, country, platform, subscription plan, and store rules.

Unless cancelled before the trial ends, a free trial may convert into a paid subscription according to the terms shown at the time of purchase.

You are responsible for cancelling before the end of the trial period if you do not want to be charged.

9. Managing and Cancelling Subscriptions

You can manage or cancel your subscription through your Apple App Store or Google Play account settings.

Deleting your Mixverse account or uninstalling the app does not automatically cancel your subscription.

To stop future billing, you must cancel your subscription through the store where you purchased it.

10. Restore Purchases

If you purchased a subscription and Mixverse does not recognize your access, you may use the restore purchases feature where available.

Purchase restoration depends on:

Restoring purchases does not create a new subscription or charge you again.

11. Refunds

Refunds are handled by Apple App Store or Google Play according to their respective refund policies.

We do not control store refund decisions.

If you believe you are entitled to a refund, you must request it through the store where you made the purchase.

Mixverse may allow you to create, save, publish, submit, upload, display, or share content, including:

You are responsible for all content you create, publish, or submit through Mixverse.

You own your content or have the necessary rights to use and publish it.

Your content does not violate any law.

Your content does not violate another person’s rights.

Your content does not infringe copyright, trademark, privacy, publicity, or other rights.

Your content is accurate where accuracy is important.

Your content is not harmful, abusive, misleading, illegal, or inappropriate.

Your content complies with these Terms.

13. Public Content

Some content you publish may be visible to other users.

14. Creator and Business Profiles

Mixverse may allow users with Creator or Business features to create public profiles and publish cocktail recipes.

You are responsible for all information you add to your Creator or Business profile.

By adding business contact information, such as a website, contact email, phone number, or address, you confirm that:

You have the right to publish that information.

The information is accurate and lawful.

The information does not violate another person’s privacy or rights.

You understand that public profile information may be visible to other users.

Do not add personal, private, sensitive, or confidential information unless you want it to be publicly visible.

We may remove, hide, restrict, or disable Creator or Business profiles, published recipes, or related content if we believe they violate these Terms, applicable law, platform rules, third-party rights, or community safety expectations.

15. License You Grant to Mixverse

You keep ownership of the content you create or publish, subject to the license you grant us below.

When you submit, create, upload, or publish content in Mixverse, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, format, adapt for technical purposes, and make your content available as needed to operate, provide, improve, protect, and promote Mixverse.

This license allows us to:

This license ends when your content is deleted from active systems, except where continued retention or display is necessary for legal, security, backup, fraud prevention, dispute resolution, compliance, or legitimate operational reasons.

16. Content Moderation and Removal

We may review, remove, hide, restrict, or disable access to content or accounts at our discretion if we believe they:

You are responsible for reviewing and verifying AI-generated content before using, relying on, publishing, preparing, or sharing it.

You agree not to use AI features to create, publish, or distribute content that:

19. AI-Generated Images and Visual Content

Mixverse may include image generation or image-related features where available.

You are responsible for reviewing any generated image before using, publishing, or sharing it.

You must not use image features to create or publish content that violates law, third-party rights, platform policies, or these Terms.

20. Cocktail, Ingredient, and Recipe Information

Cocktail recipes, ingredient information, preparation steps, measurements, recommendations, taste descriptions, strength estimates, and related suggestions are provided for informational and entertainment purposes only.

Always follow the laws, age requirements, health guidance, and safety rules that apply to you.

22. Health, Safety, and Allergen Disclaimer

Mixverse does not provide medical, nutritional, health, or safety advice.

Cocktails and ingredients may contain allergens, alcohol, sugar, caffeine, or other substances that may not be suitable for everyone.

You are responsible for checking ingredients, allergies, dietary restrictions, medication interactions, pregnancy-related guidance, health conditions, and any other personal safety concerns before preparing or consuming any recipe.

If you have health concerns, consult a qualified professional.

23. App Availability and Changes

We may update, modify, suspend, limit, or discontinue any part of Mixverse at any time.

Some features may be experimental, limited, unavailable, region-specific, subscription-based, or subject to change.

We do not guarantee that Mixverse will always be available, uninterrupted, secure, error-free, or compatible with every device, operating system, country, or platform.

We may release updates that add, change, or remove features.

24. Account Management, Data Export, and Account Deletion

You can manage your Mixverse account directly inside the app.

From there, you may be able to:

Where available, you can download a CSV copy of your Mixverse account data from inside the app.

The exported file may include account-related app data such as profile information, saved recipes, favorite cocktails, cabinet items, shopping cart items, notes, reviews, ratings, creator content, business profile information, and other information associated with your account.

The export reflects the data available for your account at the time of export.

Account Deletion

You can permanently delete your Mixverse account from inside the app.

Account deletion is permanent. After your account is deleted, your account data may not be recoverable.

When you delete your account, your active account data is deleted from our production systems immediately, unless limited retention is necessary for legal, security, fraud prevention, payment, dispute, backup, or compliance reasons.

If you have a Creator or Business profile, your public profile information is removed or hidden from active public display after account deletion.

Published content associated with your account may be deleted, unpublished, or anonymized unless retention is required for legal, security, payment, fraud prevention, dispute, backup, or compliance reasons.

Deleting your Mixverse account does not automatically cancel subscriptions purchased through Apple App Store or Google Play.

To stop future billing, you must cancel your subscription through the store where you purchased it.

25. Privacy

Your use of Mixverse is also governed by our Privacy Policy.

26. Intellectual Property

Mixverse, including its design, branding, interface, software, features, logos, trademarks, graphics, text, original content, and other materials, is owned by us or our licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, sell, modify, publicly display, publicly perform, create derivative works from, or exploit Mixverse except as allowed by these Terms or with our written permission.

All rights not expressly granted to you are reserved.

27. Feedback

If you send us feedback, ideas, suggestions, bug reports, feature requests, or other comments, you allow us to use them without restriction or compensation to you.

We may use feedback to improve, modify, develop, market, or operate Mixverse.

You are not required to provide feedback.

28. Third-Party Services and Links

Mixverse may rely on or link to third-party services, including:

We are not responsible for third-party services, websites, content, policies, actions, or availability.

29. Apple App Store Terms

If you downloaded Mixverse from the Apple App Store, the following additional terms apply:

These Terms are between you and us, not Apple.

Apple is not responsible for Mixverse or its content.

Your license to use Mixverse is limited to use on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and applicable App Store rules.

Apple has no obligation to provide maintenance or support for Mixverse.

To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to Mixverse.

If Mixverse fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, according to its policies. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to Mixverse.

Apple is not responsible for addressing claims relating to Mixverse or your possession or use of Mixverse, including product liability claims, legal or regulatory claims, or consumer protection claims.

If a third party claims that Mixverse or your use of Mixverse infringes that third party’s intellectual property rights, we, not Apple, are responsible for investigating, defending, settling, or resolving the claim, to the extent required by these Terms and applicable law.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as third-party beneficiaries.

30. Google Play Terms

If you downloaded Mixverse from Google Play, the following additional terms apply:

Your download and use of Mixverse may also be subject to Google Play’s terms and policies.

Purchases, subscriptions, billing, cancellation, and refunds may be handled through Google Play according to Google Play’s rules.

You are responsible for managing your subscription through your Google Play account where applicable.

31. No Warranty

Mixverse is provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, reliability, availability, accuracy, security, compatibility, and non-infringement.

We do not guarantee that:

32. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, subscriptions, content, business opportunities, or other intangible losses arising from or related to your use of or inability to use Mixverse.

To the fullest extent permitted by law, our total liability for any claim related to Mixverse will be limited to the amount you paid to use Mixverse during the three months before the claim arose, or 50 EUR, whichever is greater.

Nothing in these Terms limits liability where liability cannot be limited under applicable law.

33. Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold us harmless from claims, damages, losses, liabilities, costs, and expenses arising from or related to:

34. Suspension and Termination

We may suspend, restrict, or terminate your access to Mixverse if we believe that:

You may delete your account from inside the app where available.

Termination or account deletion does not automatically cancel active subscriptions purchased through Apple App Store or Google Play.

35. Changes to These Terms

We may update these Terms from time to time.

If we make significant changes, we may notify you through the app or by other appropriate means.

The updated Terms will be effective when posted, unless a different effective date is stated.

By continuing to use Mixverse after updated Terms become effective, you agree to the updated Terms.

If you do not agree to the updated Terms, you must stop using Mixverse.

36. Governing Law and Consumer Rights

These Terms are governed by applicable laws, except where mandatory consumer protection laws in your country or region require otherwise.

Nothing in these Terms limits any mandatory consumer rights that cannot be waived or limited under applicable law.

If any part of these Terms is found to be invalid or unenforceable, the remaining parts will remain in effect.
